#Why do UK261 and EU261 cover Emirates only on flights departing the UK or EU?
ARE-0001 is Emirates' entry on EASA’s list of authorised third-country operators, updated 14 September 2026, and the airline is not on the CAA’s list of UK Type A licence holders. EU261 covers flights into the EU only on Community carriers, and UK261 flights into the UK only on UK or Community carriers, so Emirates is covered on departures alone.

Only the departure airport decides; under UK261, a single booking counts from its first airport. Airports in Iceland, Norway and Switzerland count as EU airports here.
Operating entity: EMIRATES, listed as third-country operator ARE-0001 on the EASA third-country operators list and absent from the UK Type A licences on the CAA airline licence holders list.
A passenger report on the MSE forum from July 2024, about a return flight from Dubai cancelled after extreme rainfall, records Emirates' answer: “I’ve only just had a response to say they aren’t giving compensation and we need to contact travel insurance.” Neither Regulation reaches a flight booked on its own that starts in Dubai, whatever the cause; for a return on the same booking, the rules we rely on do not settle the point.

#How much does Emirates owe for a 3-hour delay from a UK or EU airport?
£220, £350 or £520 per passenger under UK261, or €250, €400 or €600 under EU261, is what Emirates owes when a flight departing a UK or EU airport reaches your final destination three hours or more late, barring extraordinary circumstances. Great-circle distance sets the band: up to 1,500 km, 1,500 to 3,500 km, or beyond.

A cancellation with less than 14 days' notice pays the same bands, unless the replacement flight fits the article 5(1)(c) time windows or extraordinary circumstances caused it. Article 7(2) then opens a halving: where the re-routing Emirates offers puts you down no more than 2, 3 or 4 hours after the original arrival, by band, the payment drops to half.
Take the Gatwick booking to the Seychelles below, 8,140 km on our own great-circle calculation. Cancelled, it pays £520 in full, or £260 where the replacement flight lands you inside four hours of the arrival time on the original ticket.
#UK261 on an Emirates flight from a UK airport
Article 6(3), in force since 14 December 2023, draws the 3-hour line at your final destination, counted from when passengers are permitted to leave the aircraft. 2 hours 59 minutes late earns nothing.
Over 3,500 km, the CAA’s delay page sets £260 for arriving “between three and four hours late” and £520 for “more than four hours”. Article 7(2) says “may”, so the £260 cut is Emirates' option rather than the rule, and the UK261 delay bands set out where each figure comes from.
#EU261 on an Emirates flight from an EU airport
Sturgeon (C-402/07 and C-432/07, 2009) gives passengers who reach their final destination three hours or more late a claim to article 7 compensation, subject to extraordinary circumstances. Paragraph 63 lets Emirates pay €300 instead of €600 on the top band when the delay is less than four hours.

#How does a connecting Emirates journey via its hub count?
1 booking with a connection counts as one journey under UK261. Article 3(1A), in force since 14 December 2023, treats a multi-leg flight booked as a single unit as a whole, departing from the first leg’s airport. A Manchester start meets the departure test even when the late leg leaves Dubai.

#UK261: Gahan v Emirates on a connection in Dubai
In Gahan v Emirates [2017] EWCA Civ 1530, the Court of Appeal held that for a single booking from an EU airport on a non-EU carrier, Manchester to Dubai to Bangkok or Sydney, compensation is assessed on the delay at the final destination, including a missed onward connection outside the EU. The UK was then an EU Member State. The decision binds lower courts in England and Wales.

Measured from the first airport, the 3,330 km Dubai leg does not pull the Gatwick booking down to £350. At 3 to under 4 hours late, the £260 cut stays Emirates' option.
#EU261: Folkerts on a connection from an EU airport
Folkerts (C-11/11, 2013) counts the delay at the final destination of a connecting flight, so a late first leg from an EU airport that costs you the Dubai connection is measured by your arrival at the last airport.

#How do you claim compensation from Emirates directly?
8 weeks without a reply from Emirates, or an answer you dispute, opens the CAA’s complaints route, so the claim goes to Emirates first and in writing. Give the flight number and date, your arrival delay, the band amount in pounds or euros, and the legal basis: UK261 article 6(3), or Sturgeon for EU261.

Put your claim for Emirates flight delay compensation in writing; the help page “Submit a form for your request” appeared in search results on 14 September 2026, so check on the day which requests it takes. Attach the booking confirmation, boarding passes and any disruption message.
A refund is a separate right. When Emirates cancels, article 8(1) lets you take reimbursement of the ticket within seven days instead of re-routing. A delay of 5 hours or more opens the same reimbursement under article 6(1). After a cancellation, the fixed compensation stays a separate claim.
A damaged or late suitcase runs on far shorter clocks. Where the Montreal Convention governs the journey, article 31 wants a written complaint within 7 days of receiving a damaged bag, or within 21 days of a delayed one reaching you; miss that and no action lies. #Where do you escalate a refused Emirates claim from a UK flight?
Emirates is not among the airlines on the CAA’s ADR lists checked 15 September 2026, whether for AviationADR, CEDR or the Berlin scheme listed for 4 other airlines. A refused Emirates claim on a UK departure goes instead to the CAA’s Passenger Advice and Complaints Team (PACT), which cannot make a binding decision.

#If Emirates rejects your claim
Ask Emirates in writing to name the cause and the reasonable measures it took, then hold that answer against article 2(o) — which causes actually qualify is worked through limb by limb there. A cause that clears the test cancels the fixed sum alone, never the meals, the hotel, the re-routing or the refund.
In an MSE forum post from January 2025 (passenger report), spaceaarvark, whose Emirates trip from Gatwick to the Seychelles went wrong at the Dubai connection, writes of a denied-boarding compensation claim that after mentioning “the available UK processes”, Emirates “came back to explain that this was down to human error and they have now paid the full compensation in line with the regulations.” One post is an anecdote.
If the CAA thinks the complaint is valid, it will “take it up with the business concerned”. It cannot “impose a solution on an airline”.
On an Emirates flight from an EU airport, complain to the enforcement body of the departure country on the European Commission’s list, updated 27 August 2026. A departure from an Irish airport goes to the Irish Aviation Authority.

#How long do you have to claim against Emirates?
6 years from when the claim arose is the England and Wales limit for a UK261 claim against Emirates, because article 3(9) applies section 9 of the Limitation Act 1980. Northern Ireland also gives 6 years. The Prescription and Limitation (Scotland) Act 1973 sets 5 years, an open point for UK261 claims.

No Scottish court has decided whether the 5-year prescription or article 3(9) governs, so file inside 5 years if a Scottish court might hear the claim. PACT will not handle a complaint with less than a year left to take legal action, so going to PACT early leaves that route open rather than closing it.
In England and Wales, a £520 claim is a small claim (limit £10,000) with a £70 issue fee. EU261 sets no period; each EU country’s own limitation rules apply.
Diarise the deadline that applies to you: six years from the flight in England, Wales and Northern Ireland, five if a Scottish court might hear it.

132 Reg 261 complaints about Emirates reached CAA (PACT) in the CAA's 2025/26 figures (April 2025 to March 2026), an estimated 25 per million passengers, and 30.0% of cases were upheld. These are complaints the ADR body or the CAA received, not delays.
