Kuwait Airways delay and cancellation compensation
14 days' notice is the line a cancellation has to cross. Cancel your Kuwait Airways flight with two weeks or more to go and no compensation is due, whatever the reason; closer than that, a UK or EU departure carries £220 to £520, or €250 to €600, and the airline has to explain itself.

- UK261 ££220–£520per passenger, 3 h or more late at arrival
- EU261 €€250–€600per passenger, 3 h or more late at arrival

#Why do UK261 and EU261 cover Kuwait Airways only on flights departing the UK or EU?
KWT-0001 records an authorisation to fly into Europe, not a European licence, and the difference decides your claim. The EASA list of 14 September 2026 carries Kuwait Airways; the CAA’s UK Type A register does not. Arrival cover asks for one of those licences, so only departures qualify.

Which rules apply to your Kuwait Airways flight
Your Kuwait Airways flight | Regulation and currency | Who takes a refused claim |
|---|---|---|
Leaves a UK airport | UK261, £ | CAA PACT, which cannot bind the airline |
Leaves an EU, Icelandic, Norwegian or Swiss airport | EU261, € | The enforcement body of that country |
Lands in the UK or the EU from Kuwait City | Neither | No claim to refuse |
Starts and ends outside the UK and EU | Neither | No claim to refuse |
Operating entity: KUWAIT AIRWAYS, listed as third-country operator KWT-0001 on the EASA list and absent from the CAA’s UK Type A list.
#UK261 on a Kuwait Airways flight from a UK airport
Fly into the UK from Kuwait City and no fixed amount is owed, however long the delay or however late the cancellation. Fly the same route outbound and the claim exists. Article 3(1A) reads a booking sold as a single unit from its first airport, so a London departure keeps its claim through a Kuwait City transfer.
#EU261 on a Kuwait Airways flight from an EU airport
A departure from Iceland or Norway counts through the EEA Agreement, and one from Switzerland through its Air Transport Agreement.
Check the first airport on your booking: it decides whether anything here applies.
#What does Kuwait Airways owe when it cancels your flight?
7 days is the second notice line, after the 14-day one. Between two weeks and seven days out, Kuwait Airways owes nothing if the replacement leaves no more than 2 hours early and lands less than 4 hours late; inside seven days that tolerance tightens, and outside both the band amount falls due.
Notice you were given | Fixed compensation |
|---|---|
14 days or more | None, art. 5(1)(c)(i) |
14 to 7 days | None if the re-routing leaves no more than 2 h before and arrives less than 4 h after; otherwise the band amount |
Less than 7 days | None if the re-routing leaves no more than 1 h before and arrives less than 2 h after; otherwise the band amount |
Extraordinary circumstances proved | None - and care, re-routing and reimbursement are still owed |

The band follows great-circle distance from your first airport to your last: £220 or €250 up to 1,500 km, £350 or €400 from there to 3,500 km, £520 or €600 beyond it. London Heathrow to Kuwait City measures 4,674 km on our own calculation: top band, delay or cancellation.
The burden of proving notice sits with the airline, so ask for the date and time of the cancellation message in writing.
Delay works on a different trigger. Reach your final destination three hours or more late out of a UK or EU airport and the same bands apply under Sturgeon (C-402/07 and C-432/07, 2009), extraordinary circumstances aside; above 3,500 km the CAA prices an arrival under four hours late at £260, and article 7(2) says “may”, making the lower figure Kuwait Airways' option rather than your ceiling (Flight delay compensation calculator).

#How do you claim compensation from Kuwait Airways directly?
A refund and a compensation claim go to different Kuwait Airways forms: Refund Request returns the ticket price, Compliments and Complaints carries the UK261 or EU261 amount. Whichever you send, name the flight number with its date, how late the doors opened, and the sum you want.

Attach the booking confirmation, the boarding passes and the message that announced the disruption, and say which airport you left.
Article 8(1) makes reimbursement and re-routing your choice, not the airline’s, and the refund lands within seven days. A passenger on r/LegalAdviceUK (7 July 2026), whose London-Lahore booking via Kuwait was cancelled 30 days out, reports: “Kuwait Airways completely abandoned their duty of care. They failed to re-route me, so I was forced to buy alternative tickets out-of-pocket to reach my destination, costing me £3K.” Thirty days' notice ends the fixed compensation; it leaves that choice, and the care owed while you wait, exactly where they were. One thread is an anecdote, not a pattern.

#Where do you escalate a refused Kuwait Airways claim from a UK flight?
0 approved schemes take a Kuwait Airways complaint. The CAA’s ADR lists, read on 15 September 2026, carry the airline under neither AviationADR, nor CEDR, nor the Berlin scheme named there for four other carriers, so a refused UK departure goes to the CAA’s Passenger Advice and Complaints Team instead.

PACT will “take it up with the business concerned” where it reads a complaint as valid, and it cannot “impose a solution on an airline” — the gap between a complaints team and a binding scheme. A claim PACT cannot settle ends in the small claims court. From an EU departure, the enforcement body of the country you left takes over, from the Commission’s list updated 27 August 2026.
#If Kuwait Airways rejects your claim
Ask Kuwait Airways in writing to name the cause and the reasonable measures it took. Article 2(o) of UK261 defines the excuse, articles 5(3) and 6(4) apply it, and between them they lift the fixed amount alone. Care, re-routing and a refund survive an extraordinary circumstance.
Compare the ADR scheme guide, ADR membership map and refused compensation guide.
#How long do you have to claim against Kuwait Airways?
6 years is what an English or Welsh court allows, because article 3(9) of UK261 sends the claim to section 9 of the Limitation Act 1980; Northern Ireland’s own statute reaches the same figure. Scotland is the unsettled one: its 1973 Act prescribes at 5 years, and no Scottish judgment has said whether that governs UK261 (Airline adr scheme list).
Source: Limitation Act 1980 s.9 and Limitation (Northern Ireland) Order 1989 art. 4, both reached through UK261 art. 3(9); Prescription and Limitation (Scotland) Act 1973 s.6 — legislation.gov.uk; CAA, How the CAA can help — caa.co.uk, checked 2026-09-15.
The 1973 Act extinguishes an obligation after five continuous years with no claim made or acknowledged, so file inside five years wherever a Scottish court might hear the case.
PACT adds a deadline of its own, and it bites earlier than the court’s. It refuses a complaint with less than a year of limitation left, which puts the practical cut-off at five years in England and Wales — and, if Scotland may be the forum, treat 4 years as your PACT cut-off. EU261 sets no period at all: each country’s own limitation rules decide.
Similar third-country airlines: Gulf Air, Qatar Airways, Saudia and Air Arabia.
Flying with a Canadian carrier instead? The Air Passenger Protection Regulations set their own cancellation rules. A lost or damaged bag goes to the Montreal Convention, a flight inside the United States to US DOT rules. Still unsure: which law covers my flight.
