New York JFK: flight cancellation and delay rights

#Which rules cover delayed and canceled flights departing JFK?
14 CFR Part 260, the federal refund rule, applies to a canceled JFK departure whatever its destination, and DOT’s own guidance is that no federal rule pays cash for a delayed or canceled domestic trip. EU261 reaches a JFK-to-EU flight only on a Community carrier; UK261 reaches a JFK-to-UK flight only on a UK or Community carrier.
The Irish Aviation Authority’s own example is New York-Dublin: a delay on that route is covered by EU261 when Aer Lingus, a Community carrier, operates it, and not covered when American Airlines flies the same city pair. The reason is article 3(1)(b): on a flight arriving in the EU from outside, only a Community operating carrier brings the regulation with it. London works the same way under UK261.

The reason is article 3(1)(b): on a flight arriving in the Any EU261 payment is owed by the operating carrier under article 3(5), not by whoever sold the ticket. On an international itinerary, DOT also points to article 19 of the Montreal Convention for expenses a delay caused you.
Read the test against the operating carrier on your boarding pass; this page names no airline as flying from JFK. #How often were JFK arrivals on time or canceled in July 2026?
59.12% of JFK’s 11,037 domestic arrivals landed on time in July 2026, against 69.49% nationally, and 11.75% were canceled, more than four times the 2.79% national rate. Diversions ran at 1.88%. Seven reporting carriers filed JFK data with the Bureau of Transportation Statistics: 9E, AA, AS, B6, DL, F9 and YX.
Cancellation, more than lateness, is what sets JFK apart this month. Denver, the most punctual of the five US airports this site compares for July 2026, canceled 0.86% of its arrivals, so JFK’s rate was 13.7 times Denver’s and 4.2 times the national one. JFK’s on-time share trailed the national figure by 10.4 points.
These are domestic arrivals of BTS reporting carriers, for one month. International flights and foreign carriers such as British Airways, Virgin Atlantic, Aer Lingus and Lufthansa are not in the file, so a JFK figure says nothing about transatlantic punctuality. Newark’s July 2026 figures, from the same file, show a different pattern: fewer cancellations, more diversions.

#What are you owed when a JFK flight is canceled?
A full refund is due under 14 CFR 260.6(a) when your JFK flight is canceled and the airline offers no alternative, or you reject the one it offers. Credit-card refunds arrive within 7 business days; cash, check, debit card and other payments within 20 calendar days. A travel voucher replaces the refund only if you affirmatively accept it.
Under 14 CFR 260.2, a “cancelled flight” is one with a specific flight number published in the reservation system when the ticket was sold that never operates. The refund is also automatic if you leave the airline’s offer unanswered and the flight departs without you. Accepting the rebooking closes the automatic-refund route for that disruption, and a voucher offered in its place must stay valid for at least 5 years.
Worked example: an $820 JFK-to-Los Angeles ticket paid by credit card, flight canceled, passenger declines the next available seat. The cancellation plus the refusal satisfies 260.6(a), so the $820, taxes and fees included, is due back within 7 business days. #Where do you complain after a canceled JFK flight?
30 days is what a US airline has to acknowledge a written complaint about a canceled JFK flight, and 60 days to answer it in full, under 14 CFR 259.7(c). Write to the airline first. If the refund still has not arrived, the DOT’s Office of Aviation Consumer Protection is the next step.
Make the first letter about the refund, not the inconvenience: flight number, date, the cancellation notice, and one plain sentence saying you decline the alternative and request a refund under 14 CFR 260.6(a). Count the days from your refusal: 7 business days for a credit-card purchase, 20 calendar days for anything else.
If that deadline passes, file through the online form at secure.dot.gov/air-travel-complaint or by post to the Office of Aviation Consumer Protection, U.S. DOT, 1200 New Jersey Ave SE, Washington DC 20590; the form page also lists 855-368-4200. The DOT directs the airline to respond to you with a copy to the Department, and it does not investigate every service complaint individually. Civil-rights complaints are the exception.
A JFK flight into the EU on a Community carrier, or into the UK on a UK or Community carrier, also carries a European claim: airline first, then the enforcement body of the arrival country, which for the UK is the Civil Aviation Authority. The US complaint page covers the DOT route in full.
