£220, £350 or £520 per passenger is the UK261 amount Virgin Atlantic owes once you reach your final destination three hours or more late, banded by distance: up to 1,500 km, 1,500 to 3,500 km, and beyond. Over 3,500 km, such as London to New York, 3 to under 4 hours late may be paid at £260.

Euro amounts apply only to departures from EU airports.
Article 7(2) says “may”, so the £260 step is Virgin Atlantic’s option, not an automatic cut. From 4 hours late, the full £520 is due. Routes up to 3,500 km have no reduced step.
Lateness counts from when you are permitted to leave the aircraft, not touchdown. An arrival 2 hours 59 minutes late earns nothing; 3 hours 0 minutes earns compensation unless extraordinary circumstances apply. Distance runs by great circle to the last destination your delay reaches.
A cancellation with less than 14 days' notice pays the same bands unless the re-routing offered fits the article 5(1)(c) windows. A replacement landing less than 2, 3 or 4 hours late, by band, lets Virgin Atlantic halve the amount.

2 Virgin Atlantic companies, Virgin Atlantic Airways Limited and Virgin Atlantic International Limited, are UK air carriers on the CAA licence list. UK261 therefore covers their flights leaving the UK, arriving in the UK, and arriving in an EU member state from outside the UK. EU261 applies only when Virgin Atlantic departs an EU airport.

#Is a Virgin Atlantic flight from the US to the UK covered?
UK261 covers a Virgin Atlantic flight from the US to the UK under article 3(1)(b)(i), in pounds, with one exception. UK261 does not apply if you received benefits or compensation and assistance in the US, as a passenger bumped from a nonstop US departure can under the DOT’s denied-boarding rule. The two payments do not stack.
US federal rules add a refund, not delay compensation. On a covered flight that is cancelled, or lands 6 hours or more late on an international itinerary, the fare is refunded if no alternative is offered or you do not accept it. Silence while the flight leaves without you does not waive it. The deadline is 7 business days for a credit card purchase, or 20 calendar days for cash, check, debit card or other payment.

Cite the article, not just the amount: 6(3) for a delay, 5(1)(c) for a cancellation, 7(1) for the sum. Virgin Atlantic answers in pounds under UK261 out of or into the UK, and in euros under EU261 only out of an EU airport.

Virgin Atlantic compensation claims start on its help centre page “How can I apply for compensation?” (virginatlantic.com, listed in search results 14 Sep 2026). Attach your booking confirmation, boarding pass and disruption message, with the flight number and date, the arrival delay or the cancellation notice you were given, and the amount from the distance table. On one booking, connecting flights count as one journey, so a missed connection is measured at your final destination.
Virgin Atlantic compensation is separate from care. Once a delay reaches 2, 3 or 4 hours by band, Virgin Atlantic owes meals, two free calls or emails, and a hotel with transport if you must stay overnight; from 5 hours you can take a refund, paid within seven days. Claim costs you paid yourself separately.

#Which Virgin Atlantic refusal reasons hold up?
2 questions decide a Virgin Atlantic refusal: which cause, and what Virgin Atlantic did about it. Article 5(3) puts both on the airline, not on you. A label such as “weather” proves neither. Which causes clear article 2(o) is worked through separately.

In Jet2.com Ltd v Huzar [2014] EWCA Civ 791, the Court of Appeal held that a wiring defect was inherent in normal airline activity, not extraordinary, though maintenance could not have prevented it. In Lipton and another v BA Cityflyer Ltd [2024] UKSC 24, the UK Supreme Court held that a captain’s illness was not extraordinary, however and whenever it arose. Both decisions bind lower courts in England and Wales.
A valid refusal removes only the fixed article 7 payment; care, re-routing and refunds under articles 8 and 9 stay owed.
#If Virgin Atlantic rejects your claim
In a Reddit r/Flights post dated 19 June 2026 (passenger report), u/stitious_belsnickel writes that a claim for a missed Heathrow connection was “Initially denied citing ”extraordinary circumstances“ (airfield congestion + weather), with incorrect departure delay numbers in their own email.” The post’s title says Virgin Atlantic “reversed a UK261 denial after I pushed back with data.”
One post is an anecdote, not a pattern. The first move after a refusal is the same every time: reply in writing, ask for the cause and the reasonable measures taken, and flag any error in Virgin Atlantic’s delay figures.
#How does AviationADR handle a Virgin Atlantic complaint?
8 weeks without a reply from Virgin Atlantic, or a final refusal, opens AviationADR, the approved ADR body the CAA lists for Virgin Atlantic (list checked 15 September 2026). For a flight departing a UK airport the escalation order is fixed: complain to Virgin Atlantic in writing first, then submit to AviationADR within 12 months of its final response or last written communication, for an incident in the last six years (five if you live in Scotland). ADR is free, and most cases are decided within three months. An accepted decision binds Virgin Atlantic; reject it and court stays open.
AviationADR, a trading name of Consumer Dispute Resolution Ltd, is one of 2 CAA-approved providers. The CAA lists the brand, not either company. On 6 April 2026 the ADR provisions of the Digital Markets, Competition and Consumers Act 2024 replaced the ADR Regulations 2015. The CAA says passengers can keep using AviationADR.

#How long do you have to claim against Virgin Atlantic?
6 years is the time limit for a Virgin Atlantic UK261 claim in England and Wales, because article 3(9) of UK261 applies section 9 of the Limitation Act 1980. Northern Ireland also allows 6 years. In Scotland, the Prescription and Limitation (Scotland) Act 1973 sets 5 years, and how that fits a UK261 claim is untested.

In Dawson v Thomson Airways Ltd [2014] EWCA Civ 845, the Court of Appeal held that a Regulation 261 delay claim sits outside the Montreal Convention’s 2-year time bar, so the 6 years in section 9 govern in England and Wales. Article 3(9) has written that rule into UK261 since 14 December 2023.
Northern Ireland reaches 6 years by either route, the 1989 Order or article 3(9). Scotland is the open point: no Scottish judgment has decided whether the 5-year prescription or article 3(9) governs. On a flight from an EU airport, EU261 sets no period; each EU country’s own limitation rules apply.
