Shorter flights have no such step. Up to 1,500 km pays €250; from there to 3,500 km, and between two EU airports over 1,500 km, €400 whatever the delay — Brussels to Athens, 2,101 km, pays €400 at 3 hours and at 6. From a UK airport the bands read £220, £350 and £520, the top one dropping to £260 on the CAA’s table below four hours.
Extraordinary circumstances that Brussels Airlines proves remove the payment and nothing else: care, re-routing and a refund all survive. A cancellation carries a separate 50% cut, measured by how late the re-routing lands you.

#Which Brussels Airlines flights do EU261 and UK261 cover, and what depends on the licence check?
European Commission licence data dated 19 May 2026 lists Brussels Airlines N.V. as a Belgian Community carrier, a status Belgium first granted on 25 April 1994, and it is what unlocks arrivals: a landing in the EU falls under EU261, a landing in the UK under UK261. Departures need no such check.

Address it to Brussels Airlines N.V., the Belgian company that holds the licence, rather than to the brand. Into it go every passenger’s name, the flight number and date, how late you reached your final destination, and the regime and amount claimed — say “EU261, article 7(1)(a), €250 per passenger.” Article 3(5) puts the duty on whichever company operated the flight, whoever sold the ticket.
State a bank transfer in your claim. A voucher is not the default and no booking condition can make it one - EU261 settles what the payment must be made in.

The CAA’s general conditions frame the route: complain to the airline first, wait the 8 weeks, file within 12 months of the final response. A Belgian departure goes elsewhere entirely — to the SPF Mobilité & Transport / FOD Mobiliteit en Vervoer, Belgium’s designated body under article 16 — and any other EU departure to that country’s body on the Commission’s list of 27 August 2026.
#If Brussels Airlines rejects your claim
Extraordinary circumstances are Brussels Airlines' only escape from article 5(3), and only where no reasonable measure could dodge them. Which causes actually clear article 2(o) is a separate question with a short answer: the reasons that qualify are set out one by one, and Wallentin-Hermann (C-549/07, 2008) is the ruling that decides where technical trouble falls. UK courts still apply it, since article 2(o) carries the same test.

#How long do you have to claim against Brussels Airlines?
2 years is the Belgian limitation period for an action born of a passenger-transport contract, set by article X.49 of the Code de droit économique and lifted from one year on 21 December 2023. Sue the airline where it is based and that is your window — a third of what an English court allows.

EU261 sets no period of its own: Cuadrench Moré (C-139/11, 2012) leaves that to national law, which is why “six years” — right for a UK261 claim in England, Wales or Northern Ireland — is the wrong number to carry into a Belgian court claim. Scotland runs shorter again at 5 years, with no ruling yet on whether its 1973 Act or article 3(9) governs a UK261 case.
