# Newark flights: 62.7% on time in July 2026, diversions 2.2%

# Newark (EWR): flight delay, diversion and cancellation rights

62.70% of Newark's July 2026 domestic arrivals landed on time, and 2.22% were diverted, the highest diversion share of the five US airports this site compares. Newark flight delays compensation, in the sense of cash for the wait, is not a federal requirement on a domestic trip. The federal refund rule lists a change of arrival airport among its significant changes, but it does not say whether a diversion after take-off is one, so ask the airline in writing for a refund of the unused journey. EU261 and UK261 reach a Newark departure only on the carriers their arrival rules name.

## Which rules cover disrupted flights departing Newark?

3 regimes can touch a Newark departure: US DOT rules on every flight, EU261 on a flight into the EU operated by a Community carrier, and UK261 on a flight into the UK operated by a UK or Community carrier. The airport never decides which of the European rules applies; the operating carrier's licence does.

Take Newark to London. UK261 covers that flight when a UK air carrier or a Community carrier operates it, and leaves it uncovered when a US carrier does, because the UK version of article 3(1)(b) names only those two kinds of operator for arrivals in the UK. EU261 applies the same operator test to arrivals in the EU, where only a Community carrier counts. Neither European rule applies where you already received benefits or compensation and assistance in the country you left.

## How did Newark arrivals perform in July 2026?

62.70% of Newark's 11,002 domestic arrivals landed on time in July 2026, and 2.22% were diverted, the highest diversion share of the five US airports this site compares. Cancellations ran at 8.36%, three times the 2.79% national rate. Ten carriers reported Newark data to BTS: 9E, AA, AS, B6, DL, F9, G4, G7, UA and YX.

[JFK](https://airtravelrights.com/airports/jfk/) diverted 1.88% of its July 2026 arrivals, so Newark's 2.22% is the higher of the two New York-area airports. Nationally it was 0.52%, so Newark ran at 4.3 times the national rate.

These figures cover one month of domestic arrivals by carriers reporting to the Bureau of Transportation Statistics. International flights and foreign carriers such as British Airways, Lufthansa and Aer Lingus are not in them, so Newark's rate says nothing about its transatlantic flights.

A cancellation and a change of arrival airport are separate refund triggers under 14 CFR 260.2, and a diversion after take-off is not clearly either. Note which word the airline used for your own flight before you pick a rule.

## What if your Newark flight is diverted or lands at another airport?

14 CFR 260.2 lists a different origin or destination airport among the changes that make a flight "significantly delayed or changed", and rejecting the alternative after such a change makes a full refund due under 260.6(a). The rule text does not say whether a diversion after departure is such a change, so a refund for one is not settled.

The same definition covers an arrival 3 hours or more late on a domestic itinerary, or 6 hours or more on an international one. Where a change the rule does name applies, rejecting the offer makes the refund automatic, within 7 business days to a credit card or 20 calendar days for other payment methods; accepting the alternative closes that route.

Under 14 CFR 259.8 the airline must tell you within 30 minutes of becoming aware of a diversion, a cancellation or a delay of 30 minutes or more, for flights scheduled within the next 7 days. Screenshot the alert and its timestamp.

Worked example: a Newark-to-Chicago flight diverts to Indianapolis, and the passenger declines the onward bus the airline offers. The rule names a changed destination airport but not a diversion in flight, so a refund here is not certain. The safe step is a written request to the airline for a refund of the unused journey, citing 14 CFR 260, with the diversion time and the date you declined. ## Where do you complain after a diverted or delayed Newark flight?

60 days is the outer limit for a US airline's full written answer to a complaint about a diverted Newark flight, after it acknowledges the complaint within 30 days, under 14 CFR 259.7(c). Complain to the airline first, then take an unanswered or inadequate reply to the DOT's Office of Aviation Consumer Protection.

Build the complaint around time: when you were told about the diversion and, if a flight tracker shows it, when the aircraft turned away. The 30-minute notice rule runs from the moment the airline became aware, so a long gap is a specific point to raise. Add the refund request if you declined the alternative, with the date you declined it.
