# Iberia delay and cancellation compensation

€250 to €600 per passenger under EU261, or £220 to £520 under UK261: that is Iberia flight delay compensation once you reach your final destination 3 hours or more late, unless Iberia proves extraordinary circumstances. Iberia is not among the members listed in the CAA ADR lists checked 15 Sep 2026. A refused UK261 claim can go to the CAA's complaints team or to court.

## How much does Iberia pay under EU261 for a delay of 3 hours or more?

€250, €400 or €600 per passenger is what Iberia owes under EU261 when you reach your final destination three hours or more late, banded by the great-circle distance to that destination. The Court of Justice set the 3-hour rule in Sturgeon (C-402/07 and C-432/07, 2009). Under UK261 the same bands pay £220, £350 or £520.

By great circle (our calculation), Madrid to Athens is 2,377 km between two EU airports, so a 3-hour 10-minute arrival delay and a 6-hour one both earn €400. New York JFK to Madrid is 5,762 km. Arriving 3 hours 30 minutes late, Iberia may pay €300 instead of €600.

Sturgeon limits that cut to a delay of "less than four hours", so at exactly 4 hours 0 minutes the full €600 is due. A cancellation or denied boarding has its own 50% cut in article 7(2), set by how late the re-routing arrives.

## Which Iberia flights do EU261 and UK261 cover, and what depends on the licence check?

19 May 2026 is the date of the European Commission licence data listing Iberia, Líneas Aéreas de España, S.A. as a Spanish Community carrier. The licence decides arrivals: EU261 covers Iberia flights into the EU, and UK261 covers Iberia flights into the UK. Departures need no licence check, because each regime covers every airline leaving its airports.

An "On arrival" entry falls away if you already received benefits or compensation and were given assistance in the country you flew from. "EU" means the 27 Member States; departures from Iceland and Norway (EEA) and Switzerland also fall under EU261.

Article 3(5) of EU261 puts the obligations on the operating air carrier. UK261's arrival rule tests "the operating air carrier of the flight concerned". A booking that names Vueling as operating carrier means a Vueling claim, not an Iberia claim. Where it names a British Airways company, a UK air carrier, EU261 does not cover that flight on arrival in the EU.

### When does UK261 apply to an Iberia flight?

UK261 covers every Iberia flight leaving a UK airport and, with the same benefits exception, every Iberia flight arriving in the UK from another country. It counts arrival when passengers are permitted to leave the aircraft. London [Heathrow](https://airtravelrights.com/airports/heathrow/) to Madrid is 1,246 km (our calculation): arriving 2 hours 59 minutes late earns nothing; from 3 hours 0 minutes, £220 per passenger is due. EU261 also covers it on arrival, subject to the same exception.

Copy the operating carrier from your booking before you file anything.

## How do you claim compensation from Iberia directly?

0 UK ADR schemes carry Iberia's name on the CAA lists checked 15 September 2026, so a refusal on a London departure leaves PACT, whose view binds nobody, and then court. Write the first claim for that audience: dated, in writing, and complete without you there to explain it.

That means each passenger's name, the flight number and date, the time you reached your final destination, and the regime and amount, for example "EU261, article 7(1)(a), €250 per passenger". The operating air carrier owes the payment under article 3(5) of EU261, so booking through an agency changes nothing.

Meal and hotel receipts belong to the separate right to care under article 9, so list them apart from the fixed amount.

Save the submission with its date: on a UK261 flight, the CAA's 8-week clock runs from your written complaint.

## Which Iberia refusal reasons count as extraordinary circumstances?

Article 5(3) of EU261 frees Iberia from the fixed payment alone, and only where it proves extraordinary circumstances that all reasonable measures could not have avoided. ### If Iberia rejects your claim

A passenger report by u/DifferentDream7004 on r/travel (Reddit, June 2026) describes an Iberia refusal citing "circumstances beyond our control". The same poster writes that "customer support let it slip that the delay was due to an operational issue where they had to pull a completely different plane to cover the route." It reports no outcome.

Reply in writing. Ask for the cause, the day it arose and the measures Iberia took. A valid refusal removes only "compensation in accordance with Article 7": meals, a hotel where needed and, after a cancellation, the choice of refund or re-routing stay owed. ## Where do you escalate a refused Iberia claim?

8 weeks without a reply, or a final refusal, lets you take a UK261 complaint about Iberia to the CAA's Passenger Advice and Complaints Team (PACT). Iberia is not among the members listed in the CAA ADR lists checked 15 Sep 2026. On EU261 flights from Spain, the enforcement body is AESA.

The CAA lists [AviationADR](https://airtravelrights.com/uk261/flight-delay-compensation/) and CEDR members, plus a Berlin scheme for Austrian, [Brussels Airlines](https://airtravelrights.com/airlines/brussels-airlines/), Lufthansa and Swiss. PACT is "only likely to consider your complaint" if the airline is not a member of an approved ADR body. In the CAA's words, PACT "will advise on whether we think you have a valid complaint, and if so will take it up with the business concerned, but we do not have the legal powers to impose a solution on an airline". Its opinion cannot be appealed; court stays open.

Article 16 of EU261 gives each Member State a body for flights from its airports and flights from third countries into them. A departure from Madrid, or an Iberia flight landing in Madrid from New York, goes to Spain's Agencia Estatal de Seguridad Aérea (AESA), División de Derechos de los Pasajeros.

## How long do you have to claim against Iberia?

6 years is the time limit to sue Iberia over a UK261 claim in England and Wales: article 3(9) applies section 9 of the Limitation Act 1980. Northern Ireland's statute also gives 6 years. For EU261, Cuadrench Moré (C-139/11, 2012) hands the period to each Member State's own limitation rules.

The Prescription and Limitation (Scotland) Act 1973 sets 5 years. No Scottish court has yet decided whether that rule or article 3(9) governs a UK261 claim.

Two passengers on a flight of up to 1,500 km claim £440 under UK261, a small claim in England and Wales, where the track runs to £10,000, with a £50 issue fee (CPR r.26.9; gov.uk court fees).

Spain answers the EU261 side twice over, and both answers say 5 years: [article 1964.2 of the Código Civil](https://airtravelrights.com/eu261/claim-in-spain/) sets the period and AESA's own claims page prints the same figure. AESA adds a step the courts do not - a written claim to Iberia first - and it has to land inside those same 5 years.

## What does Iberia owe you while you wait at the airport?

2 hours or more of expected delay beyond scheduled departure starts care on an Iberia flight of up to 1,500 km. Article 6(1) of EU261 sets 3 hours for flights between two EU airports over 1,500 km and other flights of 1,500 to 3,500 km, and 4 hours for all others.

Care under article 9 means free meals and refreshments in reasonable relation to the wait. It also covers two telephone calls or e-mails. Iberia owes a hotel and airport transfers too when the new departure is at least the day after and an overnight stay becomes necessary. UK261 draws its lines by distance alone. Care starts at 2 hours from London Heathrow to Madrid and at 4 hours from New York JFK to Madrid.

A delay of at least 5 hours gives you [reimbursement](https://airtravelrights.com/uk261/right-to-care-meals-hotels/) of the full cost of the ticket within seven days under article 8(1)(a) of EU261 and UK261. That refund is not the fixed compensation under article 7.
