# Etihad Airways delay and cancellation compensation

Hour 4 and hour 3 are the two clocks on an Etihad Airways flight out of a UK or EU airport. From hour 4 of an expected departure delay on the 5,516 km Heathrow run to Abu Dhabi, the airline owes meals, calls and a bed. From 3 hours late at your final destination it owes £520 or €600, unless extraordinary circumstances caused the delay. Fly the other way and neither clock starts.

## Which hour starts which duty on an Etihad Airways flight?

Two clocks run, and they are not the same clock. Care starts at hour 2, 3 or 4 of the delay Etihad Airways expects at the gate, by distance band. Compensation starts at 3 hours late on arrival, and only then if no extraordinary circumstance explains it.

Both routes measured on this page sit past 3,500 km: London Heathrow to Abu Dhabi, 5,516 km, and Frankfurt to Abu Dhabi, 4,863 km, each on our own great-circle calculation. On either one the gate clock reaches hour 4 before a sandwich is owed, while the arrival clock pays from hour 3. A passenger can be owed nothing at the gate and £520 by the time the doors open.

## Which Etihad Airways flights do the two clocks reach?

Neither clock starts on a flight into the UK or the EU. Etihad Airways holds no UK or EU operating licence: EASA lists it as third-country operator ARE-0002, updated 14 September 2026, and the CAA's UK Type A register does not name it. Departures only, then.

Stopped is not the same as nothing. On MoneySavingExpert thread 6623825, 14 August 2025, the passenger who opened it recorded the airline offering "just about £110 cash... or about £150 in credit" after a flight from Asia missed its Abu Dhabi connection to London (passenger report). AustinZ, on the same thread that day, said what had come before that: "Yes, they paid for hotel, food, taxis to and from hotel." jimi_man's reply gives the reason the cash stopped there: "The EU 261 (UK261) rules don't apply here as it's a non EU airline and it's not flying FROM the UK/Europe."

He was right on the law. Hotel and meals on an inbound journey are the airline's own policy, not a duty either Regulation imposes, and the £110 offered is not the £520 an arrival "over 18 hours later than original" would have carried on a Heathrow departure, extraordinary circumstances aside.

## Hour 4 at the gate: what Etihad Airways hands over

Hour 4 of an expected departure delay is the line on both routes measured here, because each runs past 3,500 km. From that hour Etihad Airways owes free meals and refreshments and two calls or e-mails, whatever the cause was: a technical fault and a closed airspace rank alike.

A bed follows once the replacement departure is at least the day after: article 9(1)(b) and (c) put the room and the transfers to it on the airline. At hour 5 article 8(1)(a) lets you abandon the trip and take the ticket price back within 7 days instead.

None of that list bends to the cause. Article 5(3) and article 6(4) release Etihad Airways from "compensation in accordance with Article 7" and from nothing else. A cause that clears the extraordinary-circumstances test therefore cancels the fixed sum alone: the meals, the bed, the re-routing and the refund all survive it.

## Hour 3 on arrival: £520 on 5,516 km, €600 on 4,863 km

£520 per passenger is the UK261 figure on London Heathrow to Abu Dhabi, 5,516 km by our own great-circle calculation. Frankfurt to Abu Dhabi, 4,863 km, carries €600 under EU261. Both sums fall due 3 hours after the scheduled arrival, and both vanish if extraordinary circumstances caused the delay.

Article 7(4) fixes those distances by the great circle method and reads them to the last destination on the ticket, so the stop at Abu Dhabi does not split the figure in two. The lower bands, £220 or €250 and £350 or €400, are out of reach on either route. A cancellation with under 14 days' notice pays the same figures, unless the replacement fits the article 5(1)(c) windows or [extraordinary circumstances](https://airtravelrights.com/uk261/extraordinary-circumstances/) caused it.

### £520 or £260 out of Heathrow

Article 6(3) starts the arrival clock at the final destination, counted from the moment passengers may leave the aircraft. 2 hours 59 minutes pays nothing. At 3 hours 0 minutes £520 falls due, with one option attached: article 7(2)(c) says the airline "may" halve it to £260, and that option dies at 4 hours 0 minutes. ### €600 or €300 out of Frankfurt

Sturgeon (C-402/07 and C-432/07, 2009) gives a passenger reaching the final destination three hours or more late the article 7 payment, extraordinary circumstances aside. Over 4,863 km that is €600, with a €300 alternative under paragraph 63 while the delay stays below four hours. Frankfurt to Abu Dhabi is no intra-Community route, so the €400 band never enters it.

## A missed Abu Dhabi connection: which arrival counts?

The last one. A single Etihad Airways ticket through Abu Dhabi is one journey, and article 3(1A), in force since 14 December 2023, reads its departure off the first leg. London Heathrow to Bangkok on one ticket measures 9,577 km, not the 5,516 km as far as the hub.

### UK261: Gahan v Emirates through a Gulf hub

In Gahan v Emirates [2017] EWCA Civ 1530 the Court of Appeal assessed a single EU-departure booking on a non-EU carrier by the delay at the final destination, counting a [connection missed](https://airtravelrights.com/missed-connection-compensation/) outside the EU. The UK was an EU Member State then, and the decision binds courts in England and Wales. Its reasoning turns on the ticket, not the hub, so an Abu Dhabi connection takes the treatment given to the Dubai one ([the Emirates card](https://airtravelrights.com/airlines/emirates/) carries those facts).

### EU261: Folkerts and a 12-hour arrival in Kuala Lumpur

Folkerts (C-11/11, 2013) reads the delay at the final destination of a connecting journey, so an EU departure keeps its claim wherever the connection failed. A boards.ie passenger report of 26 March 2025 describes a Dublin to Abu Dhabi to Kuala Lumpur booking losing its connection to a 1.5-hour delay and arriving "about 12hrs late". The poster stayed overnight in Abu Dhabi and adds: "I lodged a complaint online with etihad and they offered me €600 compensation, or €820 in Etihad credit." That arrival cleared three hours many times over; the post says neither who paid for the room nor what caused the delay.

Keep every boarding pass. Whether a return leg on the same ticket carries a claim of its own is not settled by the rules this site relies on.

## Asking Etihad Airways for the receipts and the fixed sum

Send 2 claims, or one letter in 2 parts. The care money is a list of receipts with dates on them; the fixed sum is 4 lines, being passenger names, flight number and date, arrival delay, and the amount with the article behind it. Only a UK or EU departure carries that second part.

Write "UK261, article 7(1), £520 per passenger", or "EU261, article 7(1)(c), €600 per passenger", and the airline knows which clock you are counting. Attach the booking confirmation, the boarding passes and whatever message announced the disruption. Offered a voucher instead of money? What article 7(3) counts as payment, and the article 15(1) bar on contract terms that remove it, both sit on the [EU261 hub](https://airtravelrights.com/eu261/).

A bag that comes off the belt late or broken is a third letter with its own dates. If the Montreal Convention governs the trip, delayed baggage compensation needs a written complaint within 21 days of the bag reaching you, and damage within 7 days of receipt. It pays proven costs up to 1,519 SDR per passenger, not a fixed sum. ## Where a refused Etihad Airways claim goes from a UK departure

To PACT, which cannot order anybody to pay. All 3 of the CAA's ADR lists read on 15 September 2026, being AviationADR, CEDR and the Berlin scheme listed for Austrian, Brussels Airlines, Lufthansa and Swiss, are silent on Etihad Airways. No binding adjudicator exists for it.

The Passenger Advice and Complaints Team will, where it thinks a complaint is valid, "take it up with the business concerned". It cannot "impose a solution on an airline", which is why a court claim stays on the table behind it. From an EU airport the address changes to the enforcement body of the departure country, listed by the European Commission on 27 August 2026.

### If Etihad Airways rejects your claim

Ask in writing for the cause and the reasonable measures taken, then hold that answer against article 2(o), or article 5(3) on an EU departure; [the causes that qualify and the ones that never do](https://airtravelrights.com/uk261/extraordinary-circumstances/) are worked through there. A cause that survives the test takes the fixed sum and leaves the meals, the hotel, the re-routing and the refund where they were.

## How long do you have to claim against Etihad Airways?

6 years, where England or Wales is the forum: article 3(9) hands the question to section 9 of the Limitation Act 1980. Northern Ireland matches that. Scotland runs 5 years under the Prescription and Limitation (Scotland) Act 1973, and no court has tested which of the two rules wins.

Treat 5 years as the working deadline wherever a Scottish court might hear the case. PACT keeps a separate rule: it turns away a complaint with under a year of limitation left. That is an argument for going early, not a sign the court deadline has shrunk.

Two passengers claiming £520 each off the same Heathrow flight to Abu Dhabi sue for £1,040 together in England and Wales, still a [small claim](https://airtravelrights.com/uk261/small-claims-court/) under the £10,000 ceiling, at an £80 issue fee. EU261 fixes no period, so the [limitation rules](https://airtravelrights.com/flight-compensation-time-limits/) of the country you left decide.

Diarise the deadline that governs the claim: 6 years from the flight in England, Wales and Northern Ireland, 5 if a Scottish court might hear it.
