# Delta Air Lines delays, cancellations and refunds: your rights

$2,150 is the most cash compensation US federal rules make Delta Air Lines pay, and only for involuntary bumping. A canceled or significantly delayed flight earns a refund, not compensation, if you decline Delta's alternative. Delta flights from an EU or UK airport that arrive 3 hours or more late pay €250 to €600 under EU261 or £220 to £520 under UK261. Its flights into the EU or the UK get neither.

## Does Delta Air Lines pay cash compensation for delays in the US?

No federal rule makes Delta Air Lines pay compensation for a delayed or canceled domestic flight. The DOT's Fly Rights guide, last updated 26 Sep 2025, says airlines are not required to compensate passengers on domestic itineraries whose flights are delayed or canceled. Delta's cash compensation entry on the DOT dashboard (last updated 11 Sep 2025) reads "No".

Fly Rights says: "compensation is required by law on domestic trips only when you are 'bumped' from a flight that is oversold." On 17 Nov 2025, DOT withdrew its 11 Dec 2024 advance notice of proposed rulemaking on cash compensation, rebooking and amenities.

International trips differ. DOT says passengers may be able to recover expenses from a delayed or canceled flight under article 19 of the [Montreal Convention](https://airtravelrights.com/montreal-convention/), by claiming with the airline. That repays costs, not a fixed sum. Any fixed Delta [delay compensation](https://airtravelrights.com/uk261/flight-delay-compensation/) turns on the route, not on US federal law.

## What has Delta Air Lines committed to for controllable delays and cancellations?

3 hours of waiting after a disruption within the airline's control is the threshold for the cash, credit and miles rows of the DOT Airline Cancellation and Delay Dashboard. Delta's column promises a hotel night and partner rebooking, not money for the wait. Of the 9 airlines, only Frontier reads "No" for hotel and ground transportation, and only Allegiant, Frontier and Southwest for partner rebooking.

These customer care promises bind Delta through its plan: "Airlines are required to adhere to the promises that they make in their customer service plan," the dashboard page says.

Since 10 Dec 2025, the Office of Aviation Consumer Protection does not treat cancellations or lengthy delays from unscheduled maintenance required by a non-deferrable airworthiness directive as "within airline control" for these commitments. That holds until further notice or the end of the cause-of-delay rulemaking.

## When must Delta Air Lines refund your ticket?

7 business days for a credit card purchase, or 20 calendar days for cash, check, debit card or other payment, is the prompt refund deadline for Delta Air Lines under 14 CFR 260.2. The refund is owed when Delta cancels or significantly changes your flight and you do not accept an alternative.

Any one row makes a flight "significantly delayed or changed".

Under 260.6(a), Delta owes a full refund of the fare, taxes and ancillary fees if it offers no alternative, if you reject the alternative, or if you do not respond and the flight departs without you. Silence does not cost you the refund. A credit or voucher replaces the money only if Delta offers it as an explicit alternative with notice of your refund right, keeps it valid for at least 5 years, and you affirmatively accept it.

Since 5 Dec 2025, and now until 7 Jul 2027, DOT does not enforce the cancellation-refund requirements in 260.6, 260.9 and 399.80(l) for a merely renumbered flight. The pause applies when you are rebooked on it and there is no significant change or delay.

## How much does Delta Air Lines pay if you are bumped from an oversold flight?

$2,150 is the cap on what Delta Air Lines owes for bumping you from an oversold flight against your will. It caps the 400%-of-fare payment due when a domestic alternate flight arrives 2 hours or more late, or an international one from the US 4 hours or more late.

Only the 2-to-4-hour band differs between the columns.

The rule covers nonstop segments originating in the US on aircraft with 30 or more passenger seats. Delta must ask for [volunteers](https://airtravelrights.com/denied-boarding-compensation/) first and offer the payment without being asked; a voucher is allowed only if its value is at least the cash amount and you are informed.

On a $420 one-way domestic fare, an alternate flight landing 90 minutes late earns $840. Landing 2 hours or more late, it earns $1,680. On a $650 fare, 400% is $2,600, so the $2,150 cap applies.

No payment is due under 250.6 if you missed ticketing or check-in rules or were seated elsewhere at no extra charge. A smaller aircraft swapped in for operational or safety reasons, or weight or balance limits on a plane of 60 or fewer seats, also rule it out.

Bumped at a US airport from a Delta flight to Europe, you get [Part 250 pay](https://airtravelrights.com/us-dot/bumped-flight-compensation/) in dollars, not EU261 or UK261. If a Community or UK carrier operates that leg, its inbound EU261 or UK261 cover does not apply once you received benefits or compensation and were given assistance in the US. Ask for the cash figure in writing before you accept a voucher.

## Why do EU261 and UK261 cover Delta Air Lines only on flights departing Europe or the UK?

2 scope rules decide it. EU261 covers any airline leaving an EU airport, and UK261 any airline leaving a UK airport. Inbound, EU261 needs an EU-licensed operating carrier, and UK261 an EU- or UK-licensed one into the UK. Delta Air Lines, Inc. holds neither licence, so its flights into the EU or the UK are not covered.

The operating carrier decides, not the flight number: if another airline operates a leg sold under a Delta flight number, its licence applies and the claim goes to it. KLM and Air France are Community carriers, covered inbound by EU261 into the EU and UK261 into the UK. Virgin Atlantic's entities are UK air carriers: UK261 covers them inbound, EU261 does not. Check the operating airline on your booking.

Both regimes pay from 3 hours late at your final destination, barring extraordinary circumstances. UK261 says so in article 6(3); for EU261, the Court of Justice held in Sturgeon (C-402/07 and C-432/07, 2009) that such passengers may claim article 7 compensation.

### How do you claim EU261 or UK261 from Delta Air Lines?

### If Delta Air Lines rejects your claim

Ask Delta to name the cause and the reasonable measures it took. Extraordinary circumstances remove only article 7 compensation, not care or re-routing. ## Where do you escalate a refused Delta Air Lines claim?

60 days is the limit for Delta Air Lines to respond in writing to a complaint under 14 CFR 259.7(c), after acknowledging it within 30 days. A US trip then goes to the DOT Office of Aviation Consumer Protection, and a UK departure to AviationADR after Delta's final response, or after 8 weeks without one.

DOT [takes complaints](https://airtravelrights.com/us-dot/airline-complaint/) online, by mail or by phone, directs the airline to respond with a copy to DOT, and does not investigate every service complaint.

For a flight from a UK airport, the CAA's [AviationADR list](https://airtravelrights.com/uk261/airline-adr-map/) names "Delta" by brand; AviationADR takes its members' complaints where the flight involves a UK airport. Apply within 12 months of Delta's final response or last written communication, for an incident in the last six years (five if you live in Scotland). ADR is free and decides most cases within three months. If you accept the decision, it binds Delta; if you do not, court stays open.
